Terms and Conditions of Use for Bricolapp

Welcome to Bricolapp! Please read these Terms and Conditions (“Terms”) carefully before using the app. Your use, access, or registration on the Bricolapp app, whether as a service provider or a client, signifies your full and unconditional agreement to be bound by all the clauses and conditions stated herein. If you do not agree to these Terms, you may not use the app.
1. Definitions
For the purposes of these Terms, the following terms shall have the meanings specified below:
- “Bricolapp” or “the App” or “the Platform”: Refers to the mobile application and electronic platform owned by bricolapp.com which provides a means to connect service providers and clients.
- “User”: Refers to any person who downloads, accesses, or uses the App in any capacity, whether as a Service Provider or a Client.
- “Service Provider”: Refers to any User who offers their professional, artisanal, or other services on the App.
- “Client”: Refers to any User who requests a service or seeks a Service Provider through the App.
- “Services”: Refers to the professional, artisanal, or any type of services offered by Service Providers and requested by Clients through the App.
- “Content”: Refers to all text, graphics, images, videos, data, information, ratings, comments, or any other materials uploaded, displayed, or published on the App by Users or Bricolapp.
2. Acceptance of Terms
By using the Bricolapp app, you acknowledge that you have read, understood, and agreed to be fully bound by these Terms. Your continued use of the App after any update or amendment to these Terms constitutes your acceptance of the modified Terms.
3. Eligibility and Registration
- Eligibility: You must be 18 years of age or older to create an account and use the App. By using the App, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement.
- Registration: Using certain features of the App requires creating an account. You must provide accurate, complete, and current information during the registration process and whenever you update your account information.
- User Accounts: Creating fake or duplicate accounts for the same person, or using false identity information, is prohibited. Bricolapp reserves the right to refuse, suspend, or terminate any account suspected of being fake, duplicated, or providing incorrect information.
- Account Security: You are solely responsible for maintaining the confidentiality of your login information, including your password, and for all activities that occur under your account. You must notify Bricolapp immediately of any unauthorized use of your account or any other security breach.
4. Nature of the Bricolapp App’s Operation
- Technological Intermediary: Bricolapp acts solely as an intermediary platform to connect Clients with independent local Service Providers. Bricolapp does not provide any services itself, does not employ Service Providers, and does not act as their agent.
- Disclaimer for Services: Bricolapp assumes no responsibility for the quality of services provided by Service Providers, their conduct, or for any disputes or damages that may arise between Users. Any agreement or transaction made between a Client and a Service Provider is the sole responsibility of both parties.
- No Employment Relationship: These Terms do not create any employment, agency, partnership, or joint venture relationship between Bricolapp and any User (including Service Providers). Service Providers operate as independent contractors.
5. Specific Terms for Service Providers
In addition to the general Terms, Service Providers agree to the following:
- Accuracy of Information: You must provide accurate and truthful information about your specialty, experience, qualifications, and prices. You may be required to provide professional certificates or licenses for certain services (such as childcare, nursing, electrical work, etc.).
- Quality of Services: You bear full responsibility for the quality of services provided, ensuring they meet professional standards and agreed-upon client expectations.
- Pricing and Flexibility: You have the right to set your own prices for the Services you offer. These prices must be fair, transparent, and consistent with local market practices. You also have the right to determine your available working hours.
- Compliance with Laws: You are responsible for complying with all applicable laws and regulations in the Kingdom of Morocco, including labor laws, tax laws, occupational health and safety laws, and any professional licenses specific to your field of work.
- Guarantees: You warrant that you have all necessary skills, experience, and equipment to provide the Services you offer in a safe and professional manner.
- No Subcontracting: You may not transfer or sell services agreed upon via Bricolapp to third parties or contract with other parties to perform work obtained through the Platform, unless explicitly agreed upon with the Client.
6. Specific Terms for Clients
In addition to the general Terms, Clients agree to the following:
- Service Description: You must provide a clear and accurate description of the requested service to enable Service Providers to properly understand the requirements.
- Verification: Clients are encouraged to conduct their own investigations regarding Service Providers before contracting with them, including reviewing ratings and agreeing on all service and pricing details.
- Respect: You must interact with Service Providers respectfully and professionally.
7. Financial Transactions
- Direct Payment: The payment method (cash, bank transfer, local payment apps, etc.) is agreed upon directly between the Client and the Service Provider. Bricolapp does not participate in the collection of payments, mediate them, or hold funds at this time.
- Payment Disclaimer: Bricolapp assumes no responsibility for any payment issues, delays, non-receipt of funds, or financial fraud between Users. The full responsibility for completing financial transactions rests solely with the Client and the Service Provider.
- Commission Policy: No commission is deducted from Service Providers’ earnings in the current version of the App.
- Future Fees: Bricolapp reserves the right to impose future fees for the use of additional features or specific services within the App. Users will be notified of any changes to the fee structure in advance and clearly.
8. Cancellations, Delays, and Refunds
- Cancellations and Delays: In case of cancellation or delay of an agreed-upon service, the party making the cancellation or causing the delay must notify the other party as soon as possible. Specific cancellation policies may apply as agreed upon by the parties.
- Refunds: The App does not intervene in the refund policy between the Client and the Service Provider. Both parties must agree directly on the refund policy and its terms.
9. Ratings and Reviews
- Ratings: Users can leave ratings and comments about the services they received or provided after the service is completed. These ratings aim to enhance transparency and improve service quality on the Platform.
- Integrity of Reviews: Publishing false, misleading, offensive, or discriminatory comments is strictly prohibited.
- Responding to Reviews: Users have the right to respond to reviews left for them in a respectful and professional manner.
- Bricolapp’s Right: Bricolapp reserves the right to remove any ratings or comments deemed offensive, irrelevant, or in violation of these Terms.
10. Content and Intellectual Property
- Bricolapp Ownership: All intellectual property rights related to the App’s design, logo, trademarks, symbols, texts, graphics, software, database, and content created by Bricolapp are exclusively owned by Bricolapp. They may not be used, copied, distributed, or reproduced without prior written permission from Bricolapp.
- User-Generated Content: You grant Bricolapp a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, display, and perform the Content you upload or publish on the App (such as profile pictures, service descriptions, ratings) for the purpose of operating, improving, and promoting the App and its services.
- Prohibited Content: Publishing any violent, pornographic, inciting, discriminatory, racist, political, illegal, infringing on others’ intellectual property rights, or otherwise inappropriate or offensive content to Moroccan society is prohibited.
- Right of Removal: Bricolapp reserves the absolute right to remove any content deemed in violation of these Terms or applicable laws, or that may harm the reputation of the App or its Users.
11. Data Protection and Privacy
- Compliance with Law: Bricolapp is committed to protecting Users’ personal data in accordance with the provisions of Moroccan Law No. 09-08 on the Protection of Individuals with regard to the Processing of Personal Data.
- Privacy Policy: Bricolapp’s Privacy Policy explains how we collect, use, store, and protect your personal information. Your acceptance of these Terms includes your acceptance of our Privacy Policy, which is an integral part of this agreement.
- Cookies: The App may use cookies and other tracking technologies to enhance the User experience and provide personalized services.
- Data Confidentiality: You must also respect the privacy of Client or Service Provider data you interact with and not use it for unauthorized purposes.
12. Prohibited Conduct
- Lawful Use: The App must be used only for lawful and authorized purposes consistent with these Terms.
- Prohibited Activities: Using the App for any immoral, illegal, discriminatory, fraudulent, or commercial activity without prior permission from Bricolapp is prohibited.
- System Manipulation: Using automated tools, robots, scripts, or any other means to interact with the App in an unauthorized manner or to manipulate services or data is prohibited.
- Discrimination and Harassment: Any form of discrimination, racism, harassment, or abuse towards any other User or third party is strictly prohibited.
- Unauthorized Access: Attempting unauthorized access to Bricolapp’s systems, User data, or any part of the App is prohibited.
- No Third-Party Account Use: The use of a Bricolapp account is limited to the person who registered it. No other person is permitted to use your account. If unauthorized use of an account is discovered, the account will be suspended immediately and legal action may be taken against the violating party.
13. Disclaimers and Limitation of Liability
- No Warranties: The App is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Bricolapp does not warrant that the App will be error-free, secure, continuously available, or that any defects will be corrected.
- Limitation of Liability: To the maximum extent permitted by law, Bricolapp shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the App.
- The conduct or content of any third party on the App.
- Unauthorized access to or alteration of your data.
- Any other matters relating to the App.
- Responsibility for Services: The Service Provider is solely legally responsible for their actions or any damage resulting from the service they provide, including any property damage or personal injuries. Bricolapp assumes no legal responsibility for the quality of services provided or any disputes or damages arising between Users.
- Technical Failures and Force Majeure: Bricolapp assumes no responsibility for service interruptions or any damage resulting from technical failures beyond our control, or force majeure events such as wars, natural disasters, epidemics, or any other events beyond our reasonable control.
- Indemnification: You agree to indemnify and hold harmless Bricolapp, its parent company, affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or costs (including legal fees) arising from or related to your use of the App or your breach of these Terms.
14. Dispute Resolution
- Direct Communication: In case of any dispute between a Client and a Service Provider, both parties are encouraged to communicate directly and attempt to resolve the dispute amicably.
- Bricolapp Intervention: Bricolapp may, at its sole discretion, intervene in disputes between Users to assist in resolving them, but without any legal obligation to resolve them or assume any responsibility towards either party.
- Jurisdiction: In case an amicable solution is not reached, the dispute shall be referred to the competent judicial authorities in the Kingdom of Morocco in accordance with applicable laws.
15. App Updates and Modifications to Terms
- App Updates: By using the App, you agree to receive automatic updates and new versions of the App, which may include changes to features or functionalities.
- Modifications to Terms: Bricolapp reserves the right to modify or update these Terms at any time. You will be notified of any material changes by posting the modified Terms on the App or by sending you a notification. Your continued use of the App after the changes are posted constitutes your acceptance of the modified Terms.
16. General Provisions
- Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. In case of any legal dispute, Moroccan courts shall have exclusive jurisdiction to hear such dispute.
- Severability: If any provision of these Terms is found to be invalid or unenforceable for any reason, that shall not affect the validity or enforceability of the other provisions, which shall remain in full force and effect.
- Entire Agreement: These Terms, along with Bricolapp’s Privacy Policy, constitute the entire agreement between you and Bricolapp regarding the use of the App and supersede any prior agreements, oral or written.
- No Waiver: Any failure by Bricolapp to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment of Rights: Users may not transfer their account or any of their rights and obligations under these Terms to a third party without prior written permission from Bricolapp.
- Communication: Notices or messages regarding your account or your use of the App may be sent to you via email, SMS messages, or in-app notifications.
- Cooperation with Security Authorities: Bricolapp has the right to cooperate with Moroccan security and judicial authorities in case of violations or investigations related to content or illegal activities on the Platform. User data will be shared upon request in legally required cases.
- Agreement Duration and Termination: These Terms remain in effect throughout your use of the App. Bricolapp may suspend or delete your account or restrict your access to the Platform if you breach these Terms or for any other reason Bricolapp deems appropriate, with or without prior notice. You can terminate your use of the App and delete your account at any time.
